Duration of a Maintenance Case in Bahrain

The time required to obtain a judgment in a maintenance case in Bahrain varies depending on the husband’s income and how easily it can be proven. If the husband has a fixed source of income that can be established through official documents, the case may take six months or less. If he is self-employed and does not have a fixed income, the proceedings may take longer than six months.

After the claim is filed, the case may be referred for investigation so that the wife can prove, including through witness testimony, that the husband has failed to provide maintenance. It is generally preferable to request maintenance from the date the claim was filed. In such cases, seeking legal advice from a lawyer can help ensure that the claim and supporting requests are properly presented.

A wife becomes entitled to maintenance from her husband from the date of a valid marriage contract, provided that she has placed herself at his disposal in accordance with the legal requirements. The wife’s maintenance becomes a debt owed by the husband from the date he stops paying it.

The amount of maintenance is assessed according to the husband’s financial position at the time it becomes due, whether he is financially well-off or facing hardship. However, even in cases of financial hardship, maintenance should not fall below the amount required to meet the wife’s essential needs.

A claim to increase or reduce maintenance is generally not heard until one year has passed from the date maintenance was imposed by a final judgment, except in exceptional circumstances. This applies whether the claim concerns a wife’s maintenance or maintenance during the waiting period.

Regarding temporary maintenance, Article (50) of the Bahraini Family Law regulates this matter and provides that:

“The judge may, upon the wife’s request, order temporary maintenance for her and her children. The judge may also order her return to the marital home. In both cases, the decision shall be immediately enforceable by operation of law.”

This means that the judge does not impose temporary maintenance on their own initiative, as doing so would amount to granting relief that was not requested by the parties. Temporary maintenance may therefore be ordered when it is specifically requested in either of the following ways:

  • Including the request for temporary maintenance in the maintenance claim petition before the court rules on the merits of the case.
  • Submitting the request during the hearing and recording it in the hearing minutes.

The spouses may also agree on a specific amount of maintenance and a particular time for payment. This may occur while the marriage remains in effect. The father and the child’s custodian may likewise agree on a fixed monthly amount to be paid for the child.
