Is it necessary to go directly to court when a commercial dispute arises?

Not always. In many cases it is possible to begin with formal legal notices or negotiate a settlement that preserves the commercial relationship and reduces costs. The most appropriate course of action — settlement, arbitration, or litigation — is assessed after reviewing the contract and the available evidence.
A commercial case relates to business activities between traders or companies, or to activities governed by commercial laws, whereas a civil case may cover non-commercial transactions. Correctly identifying the legal classification is important for determining the competent court and the applicable procedures.
