How to Register a Divorce in Court in Bahrain

When married life can no longer continue and the spouses are unable to live together, divorce may take place through the husband’s exercise of the right to divorce.

Khula, on the other hand, is generally initiated at the wife’s request in return for compensation. Under Sunni jurisprudence, divorce may take effect through clear verbal wording or in writing.

If the husband is unable to pronounce or write the divorce, he may express it through a clear and understandable gesture. Under Jaafari jurisprudence, divorce takes place through an explicit verbal formula. If the husband is unable to pronounce it, writing or an understandable gesture may be used in cases of inability.

If the divorce takes place outside the court in Bahrain, it may be established through two main methods:

  • Admission: An admission is a person’s acknowledgment of a legal fact claimed against them for the purpose of treating that fact as established. It is considered a judicial admission when made by a party before the court. It is considered an extrajudicial admission when made outside the court proceedings or outside the case concerning the acknowledged fact. The general rules of evidence apply when proving an admission.
  • Witness evidence: Bahraini law allows divorce to be established through witness testimony. Witnesses may appear before the court and testify to the facts relied upon by the claimant in support of the case.

Documents Required to Register a Divorce in Court

Before filing a case to establish a divorce before a Bahraini court, prepare the required documents, which may include:

  • The claimant’s ID card or passport.
  • Copies of the marriage certificate.
  • The identification documents of the witnesses, if any.

Regarding evidence, Article 64 of Legislative Decree No. 14 of 1996 promulgating the Law of Evidence in Civil and Commercial Matters provides that witness testimony may also be used in certain cases.

This may apply to matters that would normally require written evidence where a physical or moral obstacle prevented the party from obtaining written proof. A marital relationship may constitute such a moral obstacle.

Witnesses must also be legally competent to testify, even where they have a relationship with the person in whose favour they are giving evidence.

All documents should be prepared in Arabic. If a document was issued outside Bahrain, it may also need to be duly authenticated by the competent authorities, including the Bahraini Ministry of Foreign Affairs and the relevant embassy, depending on the document and its country of issuance.
