These provisions are included in the Bahraini Family Law No. (19) of 2017, from Article (49) to Article (53), while Article (54) and the following articles address cases where this maintenance is lost.
The main provisions included in these articles are as follows:
Article (49)
This article confirms that wife maintenance is an obligation upon the husband once a valid marriage contract has been concluded, even if the wife is financially independent, provided that she has made herself available to him, either actually or legally.

Wife maintenance does not lapse due to the husband’s inability or insolvency and has priority over other debts.

Maintenance According to Sunni Jurisprudence
- Comprehensive maintenance is due to a woman observing her waiting period after a revocable divorce, as well as after annulment or consummation under an invalid marriage.
- A woman observing her waiting period after an irrevocable divorce is not entitled to maintenance if the reason for divorce is attributable to her. However, she retains the right to accommodation throughout her waiting period.
- If the divorced woman is pregnant, her former husband must provide her with comprehensive maintenance throughout her waiting period, which ends upon childbirth.
Maintenance According to Jaafari Jurisprudence
- Comprehensive maintenance is due to a divorced woman observing her waiting period after a revocable divorce.
- A woman observing her waiting period after an irrevocable divorce is not entitled to maintenance.
- If the divorced woman is pregnant, her former husband must provide her with comprehensive maintenance throughout her waiting period, which ends upon childbirth.
Conditions for the Wife’s Entitlement to Maintenance Under Bahraini Law
According to Bahraini Family Law, the wife’s entitlement to maintenance begins once two essential conditions are fulfilled:
- Validity of the marriage contract.
- The wife making herself available to the husband, either actually or legally.
Although the wife has financial independence or sufficient wealth, this does not affect her right, as maintenance remains an established right as long as the marriage continues.
Within this legal framework, the following points clarify the conditions:
- The marriage contract must be valid for the wife’s entitlement to maintenance to continue.
- Maintenance remains payable even if the wife is financially capable, including cases such as Working Wife Maintenance in Bahrain.
- The husband’s inability or insolvency does not remove the obligation, as maintenance has priority over other debts.
This legal framework reflects Bahrain’s approach to ensuring the wife’s decent living conditions during marriage and in situations such as Wife Maintenance Before Divorce in Bahrain, as long as the legal requirements remain fulfilled.
Assessment of Wife Maintenance in Bahraini Courts
When applying the rules of Wife Maintenance Rights Under Bahraini Law, and when the wife files a maintenance claim, the judge considers several factors to ensure a fair assessment. The court exercises judicial discretion within objective legal standards.
The maintenance amount is assessed based on:
- The husband’s financial ability, whether he is wealthy or facing financial hardship.
- The wife’s essential needs, including accommodation, food, clothing, medical care, and other necessities according to the accepted standard of living in society.
- The circumstances of time, place, and common customs, taking into account changes in living conditions.
- Either party may request an increase or decrease in maintenance after one year from the date of the judgment, unless circumstances arise that justify urgent consideration.
- The wife may request a set-off between her maintenance debt and any amount she owes to her husband, and her request will be accepted immediately. However, the husband’s request for set-off will only be accepted if the wife is financially capable and able to pay from her own private funds.
This balance shows the court’s approach to achieving fairness by considering both the wife’s and husband’s circumstances while maintaining a balance between a decent standard of living and the financial obligations of both parties.

The same applies if she leaves for lawful work when the husband knew about her work at the time of marriage, when she expressly included this condition in the marriage contract, or when the husband allowed her to work after marriage, according to Article (56).
