What Is the Husband’s Legal Obligation to Pay Maintenance in Bahrain?
Spousal maintenance is considered one of the main legal consequences of marriage. Bahraini law requires the husband to provide maintenance for his wife and children. Article 49 of the Bahraini Family Law states that the wife is entitled to maintenance from the date of a valid legal marriage. According to Article 46, maintenance includes food, clothing, housing, and other necessities determined according to accepted customs.
It is worth noting that the obligation to provide maintenance applies to the husband even if the wife has sufficient financial means. Maintenance is her legal right and becomes the husband’s obligation in return for the marital relationship. If the wife makes herself available for marital life, the husband must provide her maintenance.

Husband’s Legal Obligation to Pay Maintenance After Divorce in Bahrain
Maintenance after divorce can be defined as the financial amount that the husband is required to provide to his divorced wife or children according to the circumstances established by law. The cases covered by the Husband’s Legal Obligation in Bahrain include the following:
- Maintenance during the waiting period (Iddah) for a woman divorced through a revocable divorce. If the divorced woman is pregnant, her right to maintenance continues until she gives birth.
- If the divorced woman has custody of her children, she is entitled to receive maintenance for her children in an amount sufficient for their care and upbringing throughout the period of custody.
- If the divorce occurs before consummation of the marriage, the divorced woman is entitled to Mut’ah compensation if she was not granted half of the specified dowry. However, if the divorce occurs after consummation, she is entitled to Mut’ah compensation unless she was the reason for the divorce.
